Began documenting financial fraud in 1984 in preparation for two days of testimony in William Wayne Justice’s Federal Court in Tyler Texas. The C.P.A. firm attesting to the financial statements on an acquired company had failed to notice that intercompany profits in self-constructed fixed assets were never eliminated during consolidation over the life of the company, creating millions of dollars in factious equity.In 1985 documented the embezzlement by an employee in Carthage Texas of thousands of dollars from a subsidiary company to our New York Stock Exchange traded public parent. Met with the district attorney and the banker to establish the validity of the evidence. Testified at a grand jury hearing. The employee pleaded guilty and accepted a ten-year sentence.Was employed by the law firm representing the unsecured creditors committee for a publicly traded company in Dallas that was in Chapter 11 bankruptcy. Analyzed the plan of reorganization, determining that it contained false assumptions. Testified as an expert witness in the Federal Bankruptcy court. The president of the publicly traded company was the only other witness. After the testimony was completed, the Judge ordered the case converted to a Chapter 7.In 1993 testified for three days in a class action suit against a big 8 accounting firm and the chairman of a publicly traded company. After reconstructing the Initial Public Offering fraud and providing documentation during the deposition, the parties settled the suit for in excess of $10 million.
