Following an initial six figure demand, the case settled for less than the cost of the defense.• Obtained partial summary judgment for client in a case that involved two deaths and two injuries. A person listed in Plaintiffs' Complaint as a "survivor" under the Florida Wrongful Death Act was not a biological or adopted child of decedent. "Survivor" collected inheritance at the probate level as he was raised almost his entire life by decedent. However, the court granted a partial summary judgment dismissing the "survivor's" claim per the argument that the rules for the Florida Wrongful Death Act are different than probate rules.• Obtained an extremely favorable five figure settlement for a national tire manufacturer in a potentially eight figure case that involved a 24-year-old who became a paraplegic following an accident. Discovery revealed the subject tire had two unrepaired punctures and one puncture that was improperly repaired with a string plug.• Limited discovery in a case involving three deaths and four injuries following a rollover accident. Plaintiffs sought discovery on a wide variety of the manufacturer client's tires including a recalled product as well as trade secret in-house testing.
