The details of my life are quite inconsequential… (Anyone?!) I suppose this is the part of my profile where I talk about my impressive legal accomplishments. With the help of colleagues, I’ve achieved some great results – both in cases I thought I should lose and in cases I thought I should win. I’ve helped lead teams that have secured hundreds of millions of dollars of settlements or judgments. I haven’t added them all up but it’s a lot. Most of my cases involving monetary damages are 8-figure disputes, with a few outliers on either side. I’ve worked in the NY office of one of the top Big Law firms around (Weil, Gotshal & Manges) helped lead the litigation team of an excellent mid-size Florida firm (Berger Singerman), clerked for the best federal judge in the universe and been recognized by Chambers USA (and Super Lawyers and Legal Elite) as “someone who knows what he’s doing” (my words not theirs). But I started Mark Migdal & Hayden with Josh and Don because I wanted to recommit to practicing law with integrity, excellence, and joie de vivre. Being based in Miami, a lot of our cases involve real estate disputes – a JV gone bad, a rogue investor, a dispute among members, or a construction issue. There is the occasional fraud case here as well (a sunny place with shady people) and business torts galore (tortious interference, anyone?). I’ve litigated a fair bit against some occasionally inept (and occasionally awesome) local governments around Florida. We’ve had some outsized success in class-action matters and are always on the hunt for opportunities to represent plaintiffs in consumer fraud cases, RICO cases, or mass tort actions. We reside in this litigation playground all day every day. It’s probably the playground of your nightmares, to the extent you have nightmares about playgrounds. I love my job. I spend inordinate amounts of time thinking about ways to help people. It’s gratifying to use my brain most of my waking hours. We are commonly local counsel to some fantastic firms around the country. Helping those firms navigate the sometimes swampy morass of South Florida is endlessly rewarding. I’ve got two kids, two dogs and I am fortunate to be married to the best person I know. Not often enough, I scuba dive, cook, read for fun and play the occasional video game. I am deeply engaged in the community and at the moment sit on the BoT of Temple Beth Sholom and the BoD of the South Florida Federal Bar Association.
