Practice highlights:• First chair of jury trial representation of the author of Point Break LIVE!, a parody of the 1991 action film Point Break, in her lawsuit against a producer for breach of contract and copyright infringement. Result: unanimous verdict and damages award for client—one of only a few trials nationwide in which a jury has decided “fair use” under the Copyright Act. See Keeling v. Case No. 10 Civ. 9345.• Represented former landowner in defending against breach of contract and environmental claims brought by real estate developer.• Represented bank in responding to SEC securities fraud investigation.

Practice highlights:• Represented Sony Music Entertainment in defending purported class actions challenging artist royalties payments on downloads of digital music and ringtones. Conducted key depositions, drafted summary judgment motions, and helped obtain favorable settlement. Shropshire v. Sony Music Entertainment, S.D.N.Y. Case No. 06 Civ. 3232 and The Youngbloods v. BMG Music, S.D.N.Y. Case No. 07 Civ. 2394.• Represented a major pharmaceutical company and its officers and directors in a securities fraud lawsuit. Obtained pre-discovery dismissal of claims against several individual defendants. Monk v. Johnson & Johnson, et al., D.N.J. Case No. 10 Civ. 4841.• Successfully defended at trial a real estate marketing company and its principals against claims for breach of contract and conversion arising from a loan by a hedge fund, and secured dismissal of related claims before trial. Bernard National Loan Investors v. Traditions Management, S.D.N.Y. Case No. 08 Civ. 3573.• Represented the co-founder of a private equity firm in a lawsuit alleging breach of fiduciary duties and breach of contract in Delaware Chancery Court. The action was settled on the first day of trial after accelerated discovery.• Represented a major stock image agency in enforcing its copyrights against unauthorized uses, and obtained several successful settlements.
