CurrentFoster Johnson’s practice focuses on complex commercial litigation, where he has represents clients in a variety of matters including contract disputes, oil and gas matters, and large scale consumer, securities, and toxic tort class actions. Foster has done work for numerous Fortune 100 energy, technology, and manufacturing companies.Foster also represents clients in appellate matters and has handled a wide variety of civil appeals and mandamus proceedings in state and federal courts, including the United States Supreme Court, the United States Courts of Appeals for the Third, Fifth, Ninth, and D.C. Circuits, the Supreme Courts of Texas and California, several intermediate state courts of appeals, and the Judicial Panel on Multidistrict Litigation. His experience includes a broad range of interlocutory appeals, amicus curiae briefs, and preserving error at the trial level. Foster received his J.D. from Stanford Law School, where he served on both the Stanford Law and Policy Review and the Stanford Technology Law Review. Prior to joining the firm, he served as a law clerk to the Honorable Priscilla Owen of the United States Court of Appeals for the Fifth Circuit. He is the author of Judicial Magic: the Use of Dicta as Equitable Remedy, 46 U.S.F. L. REV. 883 (2012).
