In addition to functions below as Legal Officer / Legal Consultant:o Alternative dispute resolution (dealing with complaints lodged with the funds; submitting responses to complainants or their legal representatives, or where escalated, to the Pension Funds Adjudicator or Financial Services Board / Financial Sector Conduct Authority and when taken further, the Financial Services Tribunalo Communicating determinations, decisions or judgments to Board, relevant sub-Committee, management etc. and proposing appropriate course of action o Drafting reports on disputes for Board’s Audit and Risk Committee and insurerso Occasional dealings with FSB/FSCA regarding Rules and other fund-related issues o Management functions (e.g., appointments; performance appraisals, package increases, leave approval, reporting, budgeting, delegating etc.)

o Setting up Legal Unito Vetting court orders and corresponding as referred to aboveo Dealing with requests from employers for deductions in terms of s37D of the PF Act or for withholding of benefits including liaising with employers, members, attorneys and other parties and referring matters to relevant sub-committee for decision o Monitoring compliance of benefit administrators with legislation and amendments, regulatory requirements and enforceable court orders and notifying management of issues or concerns o Providing legal advisory support and general legal administration serviceso Dealing with members’ legal enquiries o Responding to member complaints or disputes in the appropriate mannero Drafting rule amendments to provide for legislative amendments, benefit changes and regulatory and other requirementso Involvement in and coordinating project teamso Briefing attorneys and counsel for purposes of litigation instituted or opposed by fund/so Conducting legal research in relevant areaso Attending meetings of Board’s Claims Committee, and submitting reports when required o Drafting opinions or recommendations for management, Boards or sub-committees regarding legislation, judgments, etc. o Obtaining external legal advice or opinion where necessary regarding the above issueso General departmental administrative functions, e.g. filing, record-keeping, reporting, etc

o Investigating death benefit matters including tracing dependants and nominated beneficiaries (lump sum benefits in terms of s37C of the Pension Funds Act) and spouses or children (pensions in terms of Rules) and obtaining relevant informationo Drafting reports for relevant sub-committees regarding lump sum benefit allocation or awarding of spouse/child pensions where necessaryo Dealing with queries and disputes regarding the above o Advising management regarding potential issues pertaining to the application by the boards and sub-committees of the rules and legislation o Vetting divorce decrees containing orders relating to pension interest and maintenance orders to ensure compliance with relevant legislation (i.e., valid orders are put into effect and that non-compliant or invalid orders are not put into effect); ensuring that other orders or efforts to reduce pension benefits are not put into effect if precluded by legislation o Corresponding with parties/their attorneys/court officers regarding such orders o Dealing with legal enquiries and obtaining legal opinions on matters related to the above

o Conducting information sessions for members at workplaces explaining fund rules and structures; assisting members with one-on-one meetings after sessionso Conducting roadshows for members and employers regarding amendments to rules or legislationo Conducting annual information sessions at funds’ head office for employer liaison officialso Publishing internal staff newsletter
