Gregory A. Mountain is the head of the Firm's Oil and Gas Land Practice. Greg manages the Firm's title practice, land support services and compulsory integration matters. Greg renders drilling, acquisition and division order title opinions to address title defects and highlight potential permitting obstacles. He also handles development agreements, joint ventures, and joint operating agreements. He has worked on all phases of well development, including lease and right of way acquisition, title matters, regulatory and permitting actions, and division order calculations. Greg also handles compulsory integration from preparing notices to representing operators at the integration hearing and adjudicatory proceedings. He has represented operators in several litigation matters in NYS Supreme Court and at the NYS Attorney General’s office in the defense of oil and gas leases. He also actively participates in the NYS Department of Environmental Conservation review process for high volume hydraulic fracturing. In addition to his oil and gas practice, Greg represents clients in an extensive array of legal matters, including general corporate matters, real estate transactions, mergers and acquisitions, land use, development and zoning matters, regulatory activities, tax certiorari proceedings and commercial litigation. He has significant experience in the renewable energy field. He has participated in NYS Public Service Commission proceedings; appeared before FERC on project licensing matters; and represented clients in NYS Supreme Court in several Article 78 proceedings, RPAPL Article 15 actions and other plenary actions; the NYS Supreme Court, Appellate Division, Third Department in the successful challenge of a condemnation proceeding; and the NYS Division of Tax Appeals where he overturned a long standing NYS Department of Tax and Finance policy on franchise taxes.
