Associate Counsel And Federalism LitigatorWisconsin Institute For Law & Liberty May 2016 - Nov 2017Milwaukee, WiAs Associate Counsel and Federalism Litigator, I focused on strategic litigation, public education, and policy analysis regarding the federal government’s overreach onto the states. As part of WILL’s Center for Competitive Federalism, I worked to advance the “competitive” federalism established by the Constitution – a system in which the authority of both the states and federal government is carefully delineated and circumscribed and which is informed by the need to protect the liberty of persons and not the prerogatives of government.Major CCF litigation efforts included filing two amicus curiae briefs with the Supreme Court of the United States on behalf of the Petitioner in G.G. v. Gloucester County School Board, urging the Court to reconsider the application of Auer deference, as well as joining other SPN-affiliated groups in filing an amicus curiae brief in Christie v. NCAA, a Supreme Court case addressing the ability of the federal government to control state lawmaking. In state court, CCF brought an original action in Smith v. Brancel, an economic liberty case involving the regulation of butter. On the policy side, CCF issued major policy reports, including Wisconsin not Washington: Unleashing the Creative Potential of a Purple State (July 2016), Wisconsin's No Growth Zone: The Impact of the Clean Air Act on Sheboygan County (July 2017), and Flambeau Mining Company: A Case Study (November 2017). -
