CurrentRepresentative Experience:• Lead trial counsel for plaintiffs in a legal malpractice action filed against one of the largest law firms in Detroit. Case was tried to a jury in the Eastern District of Michigan, and resulted in a $5 million plaintiffs' verdict.• Co-trial counsel in a month-long aiding and abetting fiduciary duty trial that resulted in an $86 million judgment in favor of the firm's client.• Successfully argued BMO Harris Bank v. Wildwood Creek Ranch, 236 Ariz. 363, 340 P.3d 1071 (2015), before the Arizona Supreme Court which changed the law regarding when borrowers face personal liability on secured loans. • Received a directed verdict after a 3-week jury trial on a $20 million lender liability claim. • Obtained the first ruling from the Arizona Court of Appeals upholding the validity of a voter referendum petition that failed to comply with Constitutional petition requirements. Forszt v. Rodriguez, 212 Ariz. 263, 130 P.3d 358 (2006)• Received a unanimous jury verdict in a lawsuit to specifically enforce a real estate sales transaction.• Co-trial counsel in the fraud case against former Arizona Governor J. Fife Symington, III that resulted in a $20 million judgment for the firm's client.• Received a defense verdict in a trial involving product distribution and Uniform Commercial Code issues in federal court in Idaho.• Successfully tried a $10 million claim for specific performance before the American Arbitration Association.• Received a directed verdict in a fraud and conversion jury trial.• Successfully tried the liability phase of an inverse condemnation and nuisance claim against a local municipality. The municipality ultimately agreed to a permanent injunction, and paid $1.4 million in damages.• Recovered a $1.2 million judgment and dismissal of a lender liability counterclaim after another jury trial in Phoenix.• Also successfully tried cases in Washington, D.C., and California.
