With almost twenty years as General Counsel for a professional employer organization, Resource Management, Inc. (“RMI”), I enhanced my solid foundation in employment law. RMI provides human resources, benefits, and payroll services to client companies, effectively serving as the HR department for those companies. I was the employment attorney for both RMI and its client companies. This experience has equipped me with a nuanced understanding of the complexities involved in both employment-law compliance and employee relations. And because many of RMI’s client companies are based in states other than Utah, I have learned to adeptly navigate many states’ employment-related laws. In my position as General Counsel, I served in several capacities and have continued to hone my skills in multiple key, pertinent areas:Legal Compliance: I acted as the employment-law backstop for the three areas in which RMI provided HR-related services, working most often and closely with RMI’s HR department. Client Counseling: I provided legal and strategic guidance to client companies, helping them to navigate complex domains of employment laws and to implement best practices. Client Representation: I represented RMI’s client companies in matters involving claims brought by current or former employees, drafting and managing their responses to state and federal agency investigations and enforcement actions through mediation and other proceedings. I also oversaw litigation in partnership with our employment practices liability insurer, ensuring a cohesive strategy throughout the process.Prior to my recent role as General Counsel, I was an associate and later a shareholder at a prominent full-service law firm in Salt Lake City, where I specialized in employment law but practiced generally in commercial litigation.

In my role as General Counsel, I had two main roles. First, I was the sole counsel to the company’s management, ensuring that RMI was complying with all applicable laws. Second, I was the legal advsisor to and support for RMI’s human resources department. In that capacity, I not only assisted RMI’s internal HR staff in handling client employee matters, but I also directly counseled client companies and represented those companies in matters before administrative agencies, such as the EEOC, the Utah Antidiscrimination and Labor Division, both the Utah and federal Wage and Hour Divisions, and the National Labor Relations Board. In my role as RMI’s clients’ outside employment counsel, each year I represented those clients on several dozen matters before Utah’s federal and state employment-related agencies. -

I practiced a wide range of commercial litigation, with an emphasis on employment law, assisting on dozens of cases each year. The types of litigation in which I was involved included real property disputes, commercial contract disputes, partnership disputes, negligence cases, civil rights cases, and employment law disputes of all types, including wrongful termination, breach of contract, harassment, discrimination, wage disputes, and breach of employment contract disputes. In all of the foregoing types of cases, I was fully involved and/or responsible for all facets of the litigation process: (1) drafting complaints and answers; (2) conducting all aspects of discovery, including taking and defending depositions, drafting and responding to interrogatories and document requests, and drafting and responding to discovery motions; (4) drafting and responding to dispositive motions; (5) drafting jury instructions and motions in limine; and (5) drafting and responding to appeals. In short, throughout my time at Jones Waldo, I was consistently developing, refining, and enhancing my litigation skills.With respect to the foregoing, I was frequently either part of a team or the sole attorney responsible for arguing a motion, whether it was a discovery-related motion or a dispositive motion. As my tenure at Jones Waldo increased, so did my level of responsibility in handling those motions before state and federal courts and agencies. I would estimate that I was second chair on dozens of motions, and I was first chair several dozen more. I also spent significant time counseling clients, primarily on employment law issues. This involved both working with clients to ensure that they treated their employees properly within the law and advising those clients on what to do in the event of current or former employee claims being brought against them.
