I concentrate my practice on the defense of complex employment and labor disputes, including class and collective actions. A significant portion of my practice has involved the preparation and enforcement of arbitration agreements. In addition, I have participated in more than 90 cases before federal and state appellate courts and in the filing of amicus briefs in those courts as well as the U.S. Supreme Court. Most recently, I filed amicus briefs in the Epic Systems Corp. v. Lewis, 138 S. Ct. 1612 (2018), and Gembarski v. PartsSource, Inc., 157 Ohio St. 3d 255 (2019) cases involving the enforcement of class action waivers under the Federal Arbitration Act and when the right to arbitrate is waived in the putative class action context. I frequently blog in the Employment Class Action Blog on class action and arbitral issues. I have also spoken at many seminars and webinars dealing with the enforcement of individual arbitration agreements and challenges based on federal and state law. I also co-authored an article entitled “Searching for Clarity Amid Confusion: An Examination of the Standards for Determining Waiver and Revival of the Right to Arbitrate,” which was published in 67 U. Kan. L. Rev. 327 (Dec. 2018). I am an elected member of the American Law Institute, a Fellow of the College of Labor & Employment Lawyers and was also the president of the William K. Thomas Inn of Court for the 2018-19 term. I accepted an Achieving Excellence (Platinum Distinction) Award on behalf of the Inn given by the American Inns of Court at the U.S. Supreme Court on October 26, 2019.
