Representing clients under investigation & appearing in the Magistrates & Tribunals (Public Inquiries). Regularly dealing with criminal breaches and regulatory compliance. Complex waste cases, TFS, ABPR, permitting, exemptions, PACE interviews under caution, appeals to the Planning Inspectorate & hearings relating to enforcement, suspension and revocation. Complex road transport cases and disciplinary Public Inquiries. Defending cases involving work place deaths and serious industrial injuries. Handling cases funded by legal expenses insurance. Advising on service related complaints & appeals against the regulators producing positive outcomes. One recent complaint accepted by the Parliamentary Ombudsman who will investigate conduct of Environment Agency. Regulatory authorities often get it wrong & when they do it is important that you have a lawyer with the relevant skill, experience & specialist knowledge to represent you. Now lost count of the number of review requests & appeals prepared & lodged on behalf of waste operators in 2017 - all related to dubious actions, conclusions and regulatory decisions by the regulators.Workload is a constant stream of investigations covering all areas of environmental permitting. Unlimited fines in the Magistrates for offences that used to have fines capped at £5000 are also creating ridiculous fines & generating appeal work. In 2017 I successfully appealed a £367,000 overloading fine down to £1000. Advising the volumetric concrete supply sector over significant changes coming in 2018 when MOTs & Operator Licensing will apply to MCBPs. I have been involved in preparing representations to the Minister, Jesse Norman MP and the DfT. Await to see how Government decides to approach these changes & what the arrangements will be for gross & axle weights for MCBPs.
