I have also defended against claims of federal preemption, section 1983, and related to the Minnesota Government Data Practices Act.Highlights:- Prevailed at the Minnesota Supreme Court in In the Matter of Minnesota Living Assistance, Inc., A17-1821, 934 N.W.2d 300 (Minn. 2019). DLI prevailed on its interpretation of Minnesota's overtime law and vindicated its ability to make novel arguments in litigation without triggering administrative rulemaking requirements;-Prevailed in Minnesota Living Assistance v. Peterson, No. 17-2658, 899 F.3d 548 (8th Cir. 2018). DLI prevailed in its argument that it was not facially preempted from enforcing state wage protections by the FLSA. -
