The Wage Theft Unit protects and advances the economic rights of all Minnesota residents, especially those from communities and backgrounds that are most vulnerable to theft and abuse, who have traditionally lacked access to the courts and attorneys.Highlights:- Prevailed at the Minnesota Supreme Court in Madison Equities v. Attorney General's Office, A20-0434, 967 N.W.2d 667 (Minn. 2021);- Led the Attorney General's Office investigation of Shipt, Inc. for misclassification of its gig economy workforce as independent contractors instead of employees;- Led the Attorney General's Office investigation of Evergreen Acres Dairy, LLC for widespread wage theft and housing violations against its immigrant workforce;-Led numerous other investigations into employment violations, including Fortune 500 companies and large franchisors, among other things;-Led numerous multistate initiatives, including a letter urging a ban on non-competes to the FTC and the amicus curiae brief in Hus Buljic v. Tyson Foods, Inc., No 21-1010 (8th Circuit) (supporting the rights of workers to bring claims related to COVID-19 conditions in the meatpacking industry)
Assistant Attorney General
I represented the people of Minnesota in the Boards and Agencies Division of the Office of the Attorney General. I represented Minnesota State agencies in the enforcement of numerous state laws, including the Minnesota Fair Labor Standards Act, Minnesota Human Rights Act, and the Occupational Safety and Health Act. I represented the State at the 8th Circuit, in federal court, the Minnesota Court of Appeals, Minnesota district court, and at the Office of Administrative Hearings. I have also defended against claims of federal preemption, section 1983, and related to the Minnesota Government Data Practices Act.Highlights:- Prevailed at the Minnesota Supreme Court in In the Matter of Minnesota Living Assistance, Inc., A17-1821, 934 N.W.2d 300 (Minn. 2019). DLI prevailed on its interpretation of Minnesota's overtime law and vindicated its ability to make novel arguments in litigation without triggering administrative rulemaking requirements;-Prevailed in Minnesota Living Assistance v. Peterson, No. 17-2658, 899 F.3d 548 (8th Cir. 2018). DLI prevailed in its argument that it was not facially preempted from enforcing state wage protections by the FLSA.
