About Jonathan Hayden

I am a Boston real estate attorney representing commercial mortgage lenders in loans for properties located throughout the United States. I also work on the intersection of property rights and land use law with the continued development of drone technology to help drone-based businesses plan and prepare for the continued development of drone policy and regulation nationwide and to help state and local governments develop drone laws and ordinances that are compatible with federal law and FAA regulations.Outside of my real estate practice, I am a former board member with Veterans Legal Services, a Boston-area nonprofit that provides legal services to the local homeless and low-income veteran community, and I have also previously served as the co-chair of the Boston Bar Association's Military and Veterans Committee.

I split my time between the Litigation and Real Estate Groups. My real estate work focused on various zoning and permitting matters for client business in and around Boston. My litigation practice involved all facets of a civil litigation practice, including drafting dispositive motions, drafting and responding to discovery requests, and drafting answers and complaints. In addition to the organization and diligence required to handle multiple matters simultaneously, I performed legal and factual research to expose options for the positive resolution of each case.
  • Us Army Judge Advocate General'S Corps
    Prosecutor
Us Army Judge Advocate General'S Corps Jul 2012 - Feb 2014
    Fort Bragg, North Carolina
I was a criminal prosecutor and trial attorney in one of the US Army's busiest prosecution offices where I handled crimes ranging from felonies like financial fraud, embezzlement, and attempted murder, to misdemeanors like drug possession and desertion.I successfully pursued 18 different cases to trial in the military judicial system which uses procedural rules largely derived from the Federal Rules of Criminal Procedure, and Rules of Evidence which are nearly direct copies of the Federal Rules of Evidence. In these cases I was responsible for all facets of trial preparation: I drafted charges, responded to defense discovery requests, negotiated potential plea deals, followed-up on new investigative leads, prepared witnesses for trial, filed motions and responses, and delivered oral arguments on motions. In addition to the 18 cases that reached trial, I also met regularly with Army and civilian investigators to make recommendations on possible investigative avenues, and ensure the admissibility of any evidence collected at trial. As investigations neared conclusion, I advised military commanders on his or her options to appropriately and efficiently respond to crimes by Soldiers in the command. In this capacity, I typically managed 20-25 ongoing investigations. My colleagues and supervisors relied on my ability for legal research and I regularly instructed my colleagues on recent changes in the law, and provide advice to other prosecutors on case strategies, discovery responses, motion responses, and the rules of evidence.Outside the courtroom, I represented the Army in administrative hearings where a board of 3 senior members of the military reviewed a commander's proposal to fire a Soldier for misconduct. In these informal hearings, I presented evidence of misconduct, cross-examined witnesses, and delivered closing arguments.
  • Us Army Judge Advocate General'S Corps
    Administrative And Civil Law Attorney
Us Army Judge Advocate General'S Corps Apr 2011 - Jun 2012
    West Point, New York
In this position I fulfilled a number of different legal roles necessary for the governing of a large university and military installation, and received the Army Commendation Medal in June 2012.I advised the Cadet Honor Committee in the quasi-judicial role of Hearing Advisor at 19 Cadet Honor Hearings. My duty in these hearings was to rule on evidentiary objections and ensure the fact-finder only considered relevant evidence. The duty required that I listen closely to witness direct and cross-examination, showing the dangerous nature of testimony by unprepared witnesses.I served as the legal advisor to officers investigating allegations of Cadet misconduct by reviewing evidence, advising the investigating officer about the proper standard of proof, and explaining the intersection between military regulations and civilian criminal law.I advised the United States Military Academy administration on over 300 different fiscal, ethical, and administrative legal issues based on: U.S. Comptroller General Opinions, the Joint Ethics Regulation, the Freedom of Information Act, and the Privacy Act of 1974.
  • Us Army Judge Advocate General'S Corps
    Tax Assistance Center Officer-In-Charge
Us Army Judge Advocate General'S Corps Jan 2011 - Apr 2011
    West Point, New York
I was the Army officer responsible for the operations of West Point's Tax Assistance Center, preparing state and federal tax returns for thousands of Cadets, servicemembers, and military retirees. As West Point's subject-matter expert on personal income tax, I prepared the university's memorandum to Cadets and their parents about how a Cadet's enrollment at West Point impacts both the parent and the child's tax returns. In addition to scheduling, training, and supervising eight tax preparers, I organized the daily operations of the Tax Center and designed the policies to quickly and properly complete over 4,000 federal and state tax returns.
  • Us Army Judge Advocate General'S Corps
    Legal Assistance Attorney
Us Army Judge Advocate General'S Corps Jun 2010 - Jan 2011
    West Point, New York
My first assignment with the JAG Corps was similar to working as a small-town attorney for the local military community. My primary duty was the preparation of 18 Cadets to defend themselves in Cadet Honor Hearings. These hearings are student-run trials used to determine if an accused Cadet violated West Point's strict Cadet Honor Code. Accused Cadets represent themselves in these hearings, but meet with an attorney to prepare. In this capacity I instructed the Cadet on constructing a coherent theory of the case and emphasizing that theory throughout voir dire, opening statements, cross-examination of witnesses, presentation of evidence, and closing arguments. I wrote motions to the quasi-judicial Hearing Advisor to exclude irrelevant and prejudicial evidence, and evidence obtained in violation of my client's rights.I assisted over fifty clients in landlord-tenant disputes, provided information and advice for divorce, adoption, and immigration. I wrote wills and end-of-life planning documents.
