Mr. Kuns brought his expertise in Labor & Employment Law to McCune and Harber LLP in 2016. Mr. Kuns deals exclusively with the firm's employment matters. His single-plaintiff experience includes representing employers in cases involving breach of contract, trade secrets, wrongful termination, harassment, discrimination, and retaliation. His class and collective action experience has involved misclassification issues, "off-the-clock" claims, meal-and-rest-break claims, rounding claims, and failure-to-reimburse claims, among others. Mr. Kuns has counseled employers through difficult interactive process and reasonable accommodation meetings, as well as various other employment related situations. During his career, Mr. Kuns has assisted in mediations, arbitrations, labor board and worker's compensation hearings, DFEH and EEOC investigations, and the like. He has negotiated and drafted non-compete, retention, employment and severance agreements. He has advised companies on cutting-edge legal matters where there is no clear answer. Today, Mr. Kuns works closely with both public and private sector clients – including a number of local school districts - to resolve their employment litigation matters.

DAR-SAV, INC., et al.: Lead attorney for Defendant Dar-Sav, Inc., in a multi-plaintiff, multi-defendant, wage and hour class action matter. Filed and opposed multiple motions to compel further discovery responses. Defended approximately ten (10) depositions, including the Person Most Knowledgeable of Dar-Sav, Inc., and various store managers. Individually took seven (7) depositions which included both plaintiffs and key witnesses of cross-defendant. Attended mediation wherein my client achieved an extremely favorable resolution.S v. LBM, et al.: Represented Plaintiff in a sexual harassment matter against her former employer and supervisor from the demand letter stage through the cusp of trial. Individually took the deposition of Defendant LBM’s Person Most Knowledgeable and C.E.O., as well as defended Plaintiff’s deposition. Amended Plaintiff’s complaint to successfully defeat Defendants’ Motion for Summary Judgment. Attended mediation wherein Plaintiff received a six-figure settlement.

Assisted at a general civil litigation firm, with a focus in Employment Law. Given a great deal of responsibility, including: drafting a motion opposing consolidation of our class action case with two other related cases; drafting motions for adjudication, demurrers, oppositions, and replies to oppositions; composing complaints and answers; propounding and responding to discovery; drafting demand letters; and legal research. Topics covered included employment, defamation, contract, and invasion of privacy.

Functioned as a legal intern in the Legal Services department. Assisted on the Anti-Violence and Domestic Violence projects. Helped draft RO's, interview clients, and performed legal research.

Taught grades K-12. Managed classes ranging from 8 to 35 students. Developed lesson plans.
