I help universities, academic medical centers, charities and other exempt organizations come into and remain compliant with federal and state tax and health requirements. I also assist exempt organizations to structure their goals so as to not general taxable income. Examples of current projects include:- Many academic institutions have developed off-shore captive insurance companies and also invest in off-shore assets. As a result, they become subjec to the Foreign Account Tax Compliance Act ("FATCA") and the Foreign Bank Account Reporting ("FBAR") requirements. I help them structure these activities, comply with complicated regulatory requirements, and assist with federal and state filings.- The the Public Health Service conflict of interest regulations apply to academic institutions and healthcare organizations who apply for or have federally funded research grants. I help ensure that their conflict of interest policies and management and enforcement provisions comply with the federal requirements.- Healthcare organizations and insurance companies are subject to various requirements of the Medicare and Medicaid programs and the Patient Protection and Affordable Care Act ("PPACA"), as well as the privacy provisions of the Health Insurance Portability and Accountability Act ("HIPAA") and the Health Information Technology for Economic and Clinical Health Act ("HI-Tech Act"). I counsel organizations on protecting health information covered by these Acts. I also work with healthcare organizations on preventing fraud and abuse through compliance with the Anti-Kickback Statute and the Stark law.- Exempt organizations that solicit charitable contributions are subject to registration and reporting requirements in the states in which they solicit. While many states accept the Unified Registration Statement, each one has some requirements applicable to only that state. I determine where they must register and help with the registration process.
