Leigh Ann Schell is Chair of Louisiana's Appellate Practice Advisory Commission and is certified as a specialist in appellate practice by the Louisiana State Board of Legal Specialization. She also heads Adams and Reese, LLP's Energy Team, composed of over 40 attorneys throughout the firm's foot print. Leigh Ann recently secured a decision from the Louisiana Supreme Court changing the state's method for determining whether general damage awards are an abuse of discretion. See Pete v. Boland Marine & Mfg. Co., LLC, 2023-00170, 2023 WL 6937381 (La. 10/20/23), ___ So. 3d ___. Leigh Ann specializes in appeals, complex litigation, toxic torts, product liability, and commercial litigation, including professional disputes. In addition to handling interlocutory writs and appeals, her appellate work includes participation at trial to preserve error and drafting and arguing significant motions in the trial courts. Also, Leigh Ann was primarily responsible for the briefing and argument before the United States Court of Appeals for the Fifth Circuit in Simoneaux v. DuPont, in which the Court favorably answered a question of first impression in the Courts of Appeals. Addressing the interaction between the False Claims Act and regulatory penalties, the Court held that unassessed regulatory penalties are not “obligations” that can give rise to FCA liability after the Fraud Enforcement and Recovery Act of 2009 amended the FCA. This ruling is important to all who must comply with regulatory statutes such as the Clean Water Act, Clean Air Act and the Toxic Substances Control Act.Leigh Ann earned her J.D. cum laude from Loyola University New Orleans School of Law. After three years of undergraduate education, she was granted early admission to Loyola Law School and went on to graduate in the top five percent of her class. In her spare time, Leigh Ann enjoys marathon running and spending time with her husband and six children
