I am a Director in the Projects Team at Burges Salmon LLP.I advise both public and private sector clients on major projects (including PPPs and PFIs/PF2s) across a broad range of sectors, including defence, transport and social infrastructure. A key aspect of my role is to ensure that clients develop, understand and are able to implement and manage contracts that are clear and as simple and user-friendly as possible, ensuring that risk sits with the contract counterparty that is best placed to manage it – whether that be from a commercial/VfM perspective or otherwise. This includes working with clients to:• identify and/or develop suitable delivery models for projects (e.g. joint ventures or other alternative delivery models etc.) • develop appropriate output/outcomes-based service specifications complete with customer dependencies;• develop appropriate payment and/or risk-share mechanisms;• appropriately address contract changes – particularly in respect of longer-term contracts; • developing appropriate contract governance and assurance processes, this is of particular importance in a public sector setting (including where public services are being delivered); and• ensure that there is appropriate knowledge transfer to the client team - so that the client has the appropriate knowledge and tools available to it to effectively manage the contract.Some examples of my recent experience include:• Transport: advising the Freight Operating Companies on their arrangements with Network Rail in relation to the fitment of ETCS equipment on freight locomotives operating across the UK. • Social Infrastructure: advising the Department for Education, local authorities and a number of ‘special/single purpose entities’ on a ‘first of their kind’ projects in the children’s social care and education sphere in respect of services that are subject to central government intervention.
