Michael Aigen is a complex commercial litigator and he has first-chaired jury and non-jury trials in state and federal courts and argued before the U.S. Court of Appeals for the Fifth Circuit, the Dallas Court of Appeals and the Houston Court of Appeals.Mike is admitted to practice in the state of Texas and before the U.S. Courts of Appeals for the Fifth Circuit and the U.S. District Court for the Northern District of Texas. In addition to Texas, Mr. Aigen has handled matters in California, Delaware, Missouri, Nevada, New Jersey, New York, Ohio, and Wisconsin. Representative Experience:• Obtained a $66 million judgment at trial for a commercial lender against a defaulted borrower on a $50 million loan.• Argued and obtained summary judgment on $215 million fraud and breach of fiduciary duty claims by investors relating to the wind-down of a hedge fund. Additionally, successfully argued the appeal where summary judgment was affirmed by the Dallas Court of Appeals. LV Highland Credit Feeder Fund LLC v. Highland Credit Strategies Fund, LP, 05-13-01118-CV, 2015 WL 5093236 (Tex. App.-Dallas Aug. 28, 2015).• Represented holders of senior-subordinated notes with a face value of approximately $30 million against a reservoir-engineering company for certifying issuer's false proved oil reserve estimates, resulting in a favorable settlement. Argued and obtained reversal of trial court's summary judgment. Highland Capital Mgmt., L.P. v. Ryder Scott Co., 402 S.W.3d 719 (Tex. App.-Houston [1st Dist.] 2012). When he is not practicing law, Michael spends most of his free time coaching youth hockey and trying to relive his childhood by playing hockey in local men's leagues.
