Brittany has broad experience advising on Environmental Health and Safety regulatory compliance. Her experience is client-centered and has also included transactional and litigation components. Because of her broad spectrum of experience, Brittany is able to identify well-rounded solutions to complex problems. She enjoys working on a wide range of issues driven by EPA, OSHA and DOT (PHMSA) requirements. Brittany's experience includes:• Defense of administrative and judicial enforcement of EHS laws• Environmental permit negotiations• State and federal environmental rulemakings• Response to environmental emergencies • Federal information requests and state open records searches• Environmental due diligence in real estate and/or corporate transactions • Advising on safe work environments under OSHA Under the major federal laws (or state equivalents), Brittany's work has included:• Clean Water Act: Administrative and judicial enforcement defense, NPDES and Section 404 environmental permit analysis and negotiation, Total Maximum Daily Load rulemakings, compliance reviews of stormwater permits, SWPPPs and SPCC Plans, implementation of Waters of the U.S. Rule, and involvement in stakeholder groups evaluating implementation of WET testing requirements • Clean Air Act: Defense of Section 112(r) enforcement actions, General Duty Clause implementation, self-disclosures under state and federal audit policies, interstate air rulemaking issues, development and implementation of greenhouse gas regulation, review and response to state and federal information requests, and defense of citizen suits • RCRA: Defense of enforcement actions, review of training procedures and compliance recordkeeping documents, assist with waste determinations, implementation of Coal Combustion Residuals rule, and hazardous waste transportation and recordkeeping• CERCLA: Superfund Cost-Recovery Issues• OSHA: citations, inspections and investigations, developing and implementing procedures
