Coordinate with insureds and outside counsel in development of strategy for defense of claims and with coverage counsel in assessment of complex claim matters. Phil is experienced in complex litigation, including employment discrimination, director and officer liability, fiduciary and professional liability matters. He has defended public entities and businesses before state and federal agencies and in state and federal court involving claims of discrimination, as well as whistleblower and retaliation claims under various state and federal anti-discrimination laws. In the area of professional liability, he has extensive experience in defending real estate agents and brokers, architects, engineers, accountants and insurance brokers and agents. Phil also has experience in real estate and land use litigation matters, including litigation involving redevelopment areas, affordable housing matters and tax appeals. He has appeared before land use boards and redevelopment agencies on a variety of residential, retail, commercial and industrial development projects. Phil counsels public and private clients in transactional, permitting, licensing, compliance and enforcement matters under federal and state health and safety, air and water pollution, hazardous and solid waste, site development and property transfer laws, such as the New Jersey Industrial Site Recovery Act ("ISRA"). Additionally, he has litigated cost-recovery and contribution claims under CERCLA and the New Jersey Spill Compensation and Control Act in federal and state court and has represented commercial, industrial and utility clients in various administrative proceedings involving permitting and licensing matters in New Jersey.He frequently acts as a panelist or moderator at seminars and other public speaking engagements. He has also authored several articles and newsletters on a range of topics including employment discrimination, real estate development, affordable housing and environmental matters.
