My clients included General Motors for whom I acted as lead counsel in Corp. v. Royal Indemnity Co. (Mich. Cir. Ct. 2004) – Dickstein Shapiro filed a lawsuit in the Michigan Circuit Court on behalf of General Motors Corporation (GM) against Royal Indemnity Company (Royal) and its various U.S. and U.K. parent companies seeking insurance coverage for asbestos and environmental-related liabilities. These parties engaged in related litigation in Delaware, Maryland, and the United Kingdom. In addition to litigation in the United States and the United Kingdom, the Firm also pursued recoveries from Royal through regulatory proceedings before both the Delaware and Michigan Insurance Commissioners. The Firm obtained a favorable ruling from the Michigan Court of Appeals, which held that Royal had a duty to defend GM against asbestos-related claims, notwithstanding Royal’s contention that the parties had commuted the coverage years before and notwithstanding a trial court ruling that the statute of limitations had passed on GM’s claim (that ruling was on appeal at the time of the settlement). The Firm successfully settled the dispute while appeals were pending before the Michigan Court of Appeals, the Michigan Supreme Court, and the appellate court in the U.K. -
