I practice primarily in the areas of civil litigation with an emphasis on creditors’ rights, lender liability defense, and general business litigation. My experience ranges from representation of creditors, secured lenders and equipment lessors in a variety of commercial matters, to more general business tort and contract disputes for our firm's corporate clients. I regularly handle lender liability defense cases for our banking clients I am admitted to practice in the following courts: Massachusetts, 1977; United States District Court for the District of Massachusetts, 1978; United States Court Appeals for the First Circuit, 1987; United States Supreme Court 1989. I am an experienced trial and appellate lawyer, and pride myself in my courtroom abilities, as well as in carefully advising clients of the costs and benefits of pursuing litigation. I have successfully represented clients in a number of appellate cases including the First Circuit Court of Appeals decision in FAMM Steel v. Sovereign Bank, 571 F. 3d 93 (1st Cir. 2009). Other significant decisions in which I was involved include Sovereign Bank v. Sturgis, 863 F. Supp. 2d 75 (D. Mass. 2012); Shawmut Bank, N.A. v. Miller, 415 Mass. 482 (1993) and Arlington Trust Co. v. Caimi, 414 Mass. 839 (1993).I co-authored an article entitled "The Equal Credit Opportunity Act is Still a Mine Field of Lender Liability", in Banker and Tradesman and an article entitled "Foreclosure, What is the Lender's Duty?" in The Conveyancer, a publication of the Massachusetts Conveyancers Association. I also co-authored an article entitled “Is There Life after Death for Judicially Dissolved Mechanics Liens?” for the Real Estate Bar Association June 2006 supplement to Lawyers Weekly.
