As Director of the Financial Crimes Division my job was to lead by example by taking on hard cases and mentoring and supporting a staff of attorneys and support professionals in litigating complex financial crimes. Our Division was the most active trial unit in the Attorney General's Office litigating securities fraud, consumer related fraud schemes and a broad spectrum of related crimes including tax fraud and tax evasion cases. As Director my role was to assess and evaluate cases for their merit and address all criminal liability for those who allegedly engaged in criminal behavior. This was a dynamic process of advising investigators on how to gather and collect evidence, addressing legal issues and challenges, victim issues, defense counsel interaction and strategizing and preparing cases for charges, litigation, trial and resolution. Financial crimes are unique in that nearly every case we prosecuted resulted in significant litigation followed often by years of post conviction work enforcing restitution orders, dealing with recidivism and monitoring compliance. Part of my role as Director was to build and maintain partnerships with other agencies and stakeholders to communicate, collaborate and build trust. We accomplished this by providing quality legal work and results.

Medicaid Fraud Control Units (MFCU) are a nationwide, federally regulated and funded entity within each state that has a Medicaid program. All fifty states and many territories now operate a MFCU. The mission of a MFCU is two fold. We investigate and prosecute fraud and false claims against the Medicaid program by those who provide services to Medicaid recipients. We have no jurisdiction over anyone who is falsely receiving Medicaid coverage or services unless they are involved in a conspiracy with a provider. One exception to this is where a recipient is causing a provider to issue fraudulent prescriptions for controlled substances. Our focus is on false claims which often entailed complex schemes and financial crimes against the State and Federal governments. During my tenure as Director, our MFCU recoverd over 140 million dollars for the State and Federal governments. An additional and vital aspect of our mission was protecting vulnerable adults who received Medicaid services either in board and care facilities or through home health related services. As Director I reviewed nearly every complaint of abuse, neglect or financial exploitation that was reported to our State Adult Protective Services organization or through our state or local ombudsman or police departments. We investigated and prosecuted many cases of abuse and neglect as well financial exploitation of vulnerable adults. Most of exploitation cases arose from family members who took advantage of their aging parents and diverted their money for themselves. As a Director, I personally prosecuted cases and worked collaboratively with my staff to investigate and bring these cases to a successful resolution.

I had the honor of teaching college level courses in criminal law and the rules of evidence to college students who were seeking to improve their lives through education. I selected text books and resources, devised the curriculum and prepared lectures and learning activities for the students. My goal was to help students to use critical thinking, informed reason and collaboration with fellow students to understand the foundations and influences on our legal system and how to navigate the process through understanding the intricate nuances of the law. I received very positive feedback from my students and administrators. I left the position due to time constraints imposed by a new position I assumed at my work at the Utah Attorney General's Office in 2006.

Prosecuted cases through grand jury to jury trial in federal court in matters relating to Project Safe Neighborhood. All prosecutions related in the unlawful use or possession of firearms by restricted persons. Handled extensive case load with short deadlines. Successfully tried and resolve 50 cases. Served as counsel to the Division of Occupational and Professional Licensing and represented multiple state licensing boards including the Physician's Licensing Board, Board of Nursing, all Boards governed by the various disciplines of mental health counseling, Dental and Dental Hygienist Licensing Board, Construction Trades, etc. Simultaneously served as counsel to the Real Estate and Appraisal Boards. Handled and extensive and diverse range of disciplinary matters. Tried hundreds of formal administrative proceedings before various boards and handled all appeals from such actions through the administrative process and the Utah Court of Appeal and Utah Supreme Court. Handled 1983 actions in Federal Court related to licensing matters. Extensive involvement in the development of laws, rules and policies in the area of professional licensing regulation. Frequent public speaker before a variety of organizations an associations. Interacted with multiple state agencies, the media and the public. Prosecuted complex cases and engaged in issues relating to professional ethics, drug diversion and unlawful conduct by licensed professionals. Selected to leader the section supervising three attorneys two support staff. Developed subject matter expertise in many areas relating to professional ethics and regulation.
