Robert M. Baratta, Jr. is a Partner in the Litigation and Real Estate and Land Use Practice Groups and his areas of focus include: Environmental Regulation, Environmental, Health and Safety, Insurance Coverage and Complex Commercial Litigation.Mr. Baratta focuses his practice on environmental-related matters. He brings substantial experience in environmental litigation and compliance counseling, general commercial litigation and contract negotiation. He has represented clients in virtually all areas of environmental and health and safety law, including brownfield remediation and redevelopment, permitting, compliance, enforcement and litigation.A significant portion of Mr. Baratta’s practice involves assisting clients with environmental cleanups under various state-run voluntary remediation programs or in response to government enforcement actions. In counseling clients in real property transactions, Mr. Baratta has utilized a number of innovative tools and products to address environmental liability concerns, including environmental risk transfers, environmental impairment insurance, fixed-price cleanup contracts and proactive and thorough due diligence. Mr. Baratta has extensive experience in negotiating agreements with federal, state and local regulatory bodies and has developed strong relationships with various federal and state agencies. He has negotiated major professional service contracts governing a multitude of services, including engineering, insurance, consulting and expert witness services.
