Shaobin has represented dozens of Chinese clients for asserting IP against infringers and handling their IP disputes, successfully defeated competitors’ challenges, minimized their exposure, and reached favorable resolutions by implementing counter actions in the USPTO, US courts, and China.* Represented Boviet Solar in a significant victory in an ITC-337 investigation filed by ASGT asserting infringement of six patents. On September 2, 2022 the administrative law judge issued a 200-page written opinion finding in favor of Boviet on multiple grounds, including no patent infringement, invalidity on certain asserted patent claims, and complainant not meeting the technical prong of the domestic industry. In March 2023, we secured an affirmation before the ITC, and thereafter forced ASGT to dismiss its parallel complaint against Boviet in the NDCA.* Represented Changzhou Kaidi in securing a complete victory in a patent infringement case filed by Limoss US in the N.D. Miss., in which the action was dismissed with prejudice. We also obtained a complete victory for Kaidi in an inter partes review (IPR) petition before the PTAB of the USPTO.* Represented Global mobile data service provider uCloudlink in defeating the trade secret misappropriation allegations in a patent case brought by competitors SIMO Holdings and Skyroam. In addition, we built strong noninfringement positions and preserved claim construction issues for uCloudlink to reverse the district court’s summary judgment and win the appeal of infringement and claim construction issues at the Federal Circuit.* Represented Jiangsu Nata in negotiating and acquiring $10 million worth of global patent families, conducted IP due diligence, and reviewed and revised the asset purchase agreement and associated papers. The inventions can improve the chemical vapor deposition or atomic layer deposition of silicon-based semiconductors and dielectric thin films.
