Terms of ReferenceTo advise the Director of Immigration on :a. implementation of the Quality Migrant Admission Scheme (QMAS), including allocation of quota under the QMAS to the most meritorious applicants having regard to sectoral mix of the shortlisted candidates, the socio-economic needs of Hong Kong in the short and longer-term, and other relevant factors; andb. implementation of the Admission Scheme for Mainland Talents and Professionals (ASMTP), in particular whether applications under the ASMTP are worthy of support having regard to (i) to (iii) -i. has a good education background, normally a first degree in the relevant field, but in special circumstances, good technical qualifications, proven professional abilities and/ or relevant experience and achievements supported by documentary evidence may also be accepted;ii. is or will be employed in a job relevant to his academic qualifications or working experience which cannot be readily taken up by the local work force; andiii. is remunerated (including income, accommodation, medical and other fringe benefits) at a rate broadly commensurate with the prevailing market level for professionals in Hong Kong.

The Registration of Persons Tribunal was established in 1987 under Section 3C of the Registration of Persons Ordinance, Cap. 177, to deal with appeals made under section 3D(1) of the Ordinance by a person who is aggrieved by a decision of a registration officer -(a) not to issue a permanent identity card to him; or(b) to declare a permanent identity card issued to him to be invalid.

The Immigration Tribunal was established in 1980 under section 53F of the Immigration Ordinance, Cap. 115, to deal with appeals lodged under section 53A of the Immigration Ordinance against the making of a Removal Order by the Director of Immigration.

The Municipal Services Appeals Board ("the Board") is an independent statutory body established under the Municipal Services Appeals Board Ordinance, Cap. 220, in August 1990. The function of the Board is to hear and determine any appeal to the Board from the Licensing Appeals Board or an administrative decision from which an appeal lies to the Board under any Ordinance, such as refusal of the issue of a liquor licence, suspension of a restaurant licence, termination of the tenancy of a market stall and etc.

The functions of Transport Tribunals are to review the decisions of the Commissioner for Transport (“the Commissioner”) in respect of applications/appeals made under the Road Traffic Ordinance (Cap. 374), the Road Traffic (Driving Licences) Regulations (Cap. 374B) and the Road Traffic (Public Service Vehicles) Regulations (Cap. 374D).

The Independent Police Complaints Council (IPCC) is an independent body established under the Independent Police Complaints Council Ordinance (IPCCO) (Cap. 604, Laws of Hong Kong) to observe, monitor and review the handling and investigation of Reportable Complaints against the Police by the Commissioner of Police.

The HKSAR Passports Appeal Board was established in 1998 under section 3 of the Hong Kong Special Administrative Region Passports (Appeal Board) Regulation, Cap. 539A, for the purposes of considering, hearing and determining appeals made under section 10(1) of the Hong Kong Special Administrative Region Passports Ordinance, Cap. 539, against any decision of the Director of Immigration in respect of - (a) the issue;(b) validity period;(c) amendment, or(d) cancellation of a passport.
