My practice focuses on regulatory compliance and business practice matters, as well as administrative law, trademarks, and drafting and negotiating agreements. I represent traditional industry members such as wineries, breweries, distilleries, importers, and retailers, as well technology clients, agencies, investors and others that need counsel in this highly regulated industry. I have a particular interest in emerging industry practices, including ecommerce sales, interstate shipping, third party marketers, and in navigating complicated tied-house laws. Representative work includes: • Advise and counsel alcoholic beverage industry clients in a variety of areas, including regulatory compliance, business disputes, licensing, intellectual property, and contractual matters. • Counsel clients on federal and state regulatory compliance issues pertaining to product importation, exportation, manufacture, distribution, and retail sales. • Represent third party provider clients on a nationwide basis on implementation and regulatory compliance with respect to ecommerce sales, delivery, wine clubs, subscription services, and other emerging practices. • Advise clients on sales, marketing and promotions, including event compliance, social media advertising, and web and mobile marketing. • Manage, plan, and draft documents for administration of contests, sweepstakes, and sponsorships. • Negotiate and draft contracts in several areas, including product distribution, asset sales, leases, marketing, advertising, and intellectual property licensing. • Serve as specialized regulatory counsel on industry merger and acquisition deals. • Handle state and federal licensing for all types of industry clients, including for retail sales, production, distribution, and importation of alcoholic beverages.

Represented a variety of clients in commercial litigation practice, as well as providing business and transactional counsel in several areas. Substantive experience in patent, copyright, trademark, antitrust, employment, insurance defense, products liability, privacy, real estate, regulatory, First Amendment, alcoholic beverage, and commercial litigation practice areas. Representative work includes: • Represented major recording companies in more than 50 federal copyright cases. Responsibilities included managing litigation, conducting settlement negotiations, preparing settlement agreements, drafting district and appellate court briefs, and arguing motions. • Represented large financial institution in several federal court cases, including in antitrust and patent litigation, as well as in other matters in the financial services practice area. • Represented several high technology companies in commercial litigation. • Drafted numerous state and federal court briefs, including summary judgment motions, demurrers, discovery motions, and appellate briefs. • Managed discovery process for state and federal litigation, including propounding and responding to discovery, investigating cases, drafting motions, and reviewing documents. • Argued motions and made other appearances in federal and state courts. • Represented alcoholic beverage clients in regulatory compliance matters, drafting and negotiating agreements, and trademark issues. • Drafted and revised various contracts, including employment, marketing, and settlement agreements. • Revised operating regulations and bylaws for large financial institution.
