My practice focuses on representing insurers, reinsurers, agents and brokers, as well as other clients involved in all aspects the surplus lines insurance markets in the United States. This includes advising alien or foreign insurers on how to comply with various state laws in placing business, advising producers on licensing, placement, and premium tax issues and advising insureds on coverage and placement issues. In particular, I am based in London and advise participants in the London market (both Lloyd's and the company market) on how to comply with U.S. insurance laws by either becoming admitted insurers or utilizing a variety of methods of placing insurance without being licensed. I represent clients with a wide variety of licensing and compliance issues. This includes resolving broker compensation and disclosure issues, name changes and approval, preparation of licensing applications, preparation of applications for certificates of authority and negotiations with departments of insurance regarding licensing and certification issues. I also help clients with statutes or regulations impacting their business. I advise insurers and producers regarding a wide variety of affiliate transactions, including preparation of the necessary applications and obtaining approvals from Departments of Insurance. I counsel on pretransaction strategies, preparation of necessary corporate documents and agreements, and execution of the application process. Further, I advise clients regarding the complex and rapidly evolving field of information privacy and restrictions on sharing personal nonpublic information with affiliates and nonaffiliates.
