I started out my legal career as a litigator by suing businesses for sexual harassment, wage and hour and discrimination violations, along with breach of contract claims, ugly family business breakups and typical business partnership divorces. After 10 years, I was frustrated with all the money and time wasted on messy lawsuits that could be prevented. Most small business owners are buried with the day-to-day of keeping the business afloat that it's not a surprise when they find themselves in a legal mess. Today I love what I'm doing because I get to help businesses avoid common mistakes or worse a lawsuit. There is relief in discovering that it probably won't cost as much as you think for such legal help. I have made it my goal to run my practice like my clients run their businesses. This means that we streamline, we have set pricing so no surprises with legal costs, and we actually make it easy for you to reach us for legal advice. We meet you over zoom video so you don't have to interrupt your busy day to meet us at an office. You won't be waiting for days or even a couple of weeks for us to return a phone call or an email. Finally, with set fees, you can plan accordingly and there won't ever be a surprise bill for additional fees in the mail from us. The most common reasons small businesses end up in a lawsuit are (1) over a misunderstanding, (2) an issue with maintaining the legal entity, or (3) issues with not complying with their employer obligations. In August 2019, my 16-year-old daughter and I participated on a humanitarian trip for 10 days with Guatemalan Humanitarian Tours. I had been searching for some type of service trip to do with my daughter and one day I happen to meet the Director, Tobie Spears at a ConnectShare event. Once Tobie explained that she takes teenagers on humanitarian trips to Guatemala, I immediately knew that I had attended that event that day just to meet her. The service Tobie had lined up for us to do was eye-opening, to say the least. I really thought I would be prepared but in reality, I was not. The needs of the children and families are too hard to understand unless you actually see for yourself. Despite the hardship and poverty, these people are full of love and joy. My heart is bigger than it was before the trip. I am so grateful my teenager had this opportunity to give her an experience that will last her the rest of her life. She now has ideas of good she can do in this world. So, it was easy for me to decide to join as a Board Member to help Tobie grow this nonprofit and continue to serve people locally and in Guatemala.

This is an online sexual harassment training that has been in the making for 15 years! I wanted to create a different kind of training that would actually engage those participating. The typical sexual harassment training is frustrating because it's boring and most of the individuals are checking email or busy doing something else. This online training is called the Workplace Environment Protection Training. Because it's online, it's convenient and affordable at only $25 per user license. What makes it different from other online training options? (1) It focuses on training the Supervisors before the whole team of employees because Supervisors are usually your first line of defense to avoid liability; (2) It allows the training to be customized to your type of business because an office environment is not always typical, harassment occurs in restaurants, retail shops, warehouses, etc.; and (3) It includes training on civility because we find that most people have no idea that their behavior is crossing a line. This training is ideal for a business with less than 50 employees who haven't implemented training yet. It's never too late to protect your business so don't put it off any longer!

I was frustrated with litigation because of all the time and money wasted on issues that could be avoided. In 2010 to better balance the high demands of career and family, I decided to leave the firm and help my husband run the business side of the dental practice we had purchased in 2006. Under my direction, our “bottom line” saw a 40% profit increase from 2009 to 2015. The reason for the improvement is we focused on streamlining our systems with employees, compliance, delivery of services, suppliers, independent contractors, and other third parties. This meant doing a better job at maintaining the legal entities we had in place, setting up appropriate contracts for our type of business and expectations, and getting organized. This allowed us to hire a 3rd dentist who became a half-owner within 2 years. Presently, these two dentists are business partners who run their dental practice by using the most efficient processes and procedures available. Efficiency keeps every team member on the same page which allows both doctors to focus their day on being successful dentists rather than worrying about the business side of their practice. As an attorney and business owner, I understand how stressful it is to stay on top of things that keep legal issues to a minimum. This is why I started Dana Ball Legal Services, to help the small business owner avoid common legal mistakes.

I was 1 of 10 attorneys working at the firm at this time. I was the only attorney who handled business matters and represented employees for sexual harassment, wrongful termination, discrimination, wage and hour claims, unemployment claims, etc. After 3 years, I decided I had enough with litigation. By that point, I had handled several family business break ups that were ugly as well as nasty business divorces between business partners. I had also represented employees of all ages with horrific and egregious sexual harassment, disability and age discrimination claims. Most of these cases lasted 2-3 years and many hours were spent on depositions, motions and witness preparation. Despite the money that my clients had to pay in legal fees, the litigation was emotionally taxing on every single individual involved and sometimes it seemed that the attorneys involved would draw out a fight just to prolong the misery. In some cases, filing a lawsuit is the only answer. However, I don't believe that every situation requires such extreme measures and I was finally done with the process. I decided to turn my focus on the preventative measures that can be taken so that an issue does not end up in a lawsuit. I know that business owners are in control of how they run their business and if they (1) put good contracts in place, (2) follow their own rules, and (3) don't ignore questions and complaints from employees and others, then the business owner will avoid a legal disaster. I like being part of the prevention side rather than the litigation side as it doesn't cost as much time and money.
