David is partner at Solomon Brothers with 25 years of experience practicing primarily in construction law (front and back end) but also practices in commercial litigation.In the field of construction law, David has acted in some of Australia’s biggest construction disputes, especially in the energy and resources sectors. Some of the disputes include the Murrin Murrin Nickel Project arbitration, acting for various contractors in disputes with Rio Tinto on the Rio Tinto RCE expansion, the Gorgon Jetty Project, several aspects of the Roy Hill Project, the Alcoa Co-Generation Project, the Mumbida Wind Farm Project and, most recently, the Ichthys Onshore Project. Outside of the energy and resources sector, he has acted on disputes arising from the construction the Perth CBD aspect of New MetroRail Project, a defence contractor with respect to a complex and extensive delay to a defence project being implemented across various sites in Australia, providing advice on a Perth Stadium dispute leading to early resolution and on numerous civil projects throughout Perth, especially shopping centers. His experience includes both domestic and international arbitration.As part of David’s construction experience, he has also acted in significant number of Construction Contracts Act disputes (for applicants and respondents), including the first successful challenge to an adjudication determination in Western Australia: Zurich Bay Holdings Pty Ltd v Brookfield Multiplex Engineering and Infrastructure Pty Ltd [2014] WASC 40. David also defends builders in building related prosecutions.With respect to commercial litigation, David has acted in all levels of Australian Courts on a diverse range of matters including the first material non-disclosure case to go to the Federal Court for the approval of a penalty (Australian Securities and Investments Commission, in the matter of Chemeq Limited (ACN 009 135 264) v Chemeq Limited (ACN 009 135 264) [2006] FCA 936), acting for the litigation funder, Bentham IMF, with respect to the collapse of the Great Southern Group (Snelgrove v Great Southern Managers Australia Ltd (In liq) (Receiver and manager Appointed) [2010 WASC 51]) and the implementation of Project Transform and, most recently, he acted in a Supreme Court trial with respect to a dispute arising from a large residential property development located between Perth and Bunbury.Lastly, David is also a former National President and AMPLA and remains a member of the Western Australian State Committee.
