Some significant matters that Emma was involved in prior to joining the Bar are:Acted for Crown Melbourne Limited in successful defence of an unconscionable conduct claim for some $20m in damages based on alleged pathological gambling condition (Kakavas v Crown Melbourne Limited & Ors [2009] VSC 559).Acted for Treofan Germany GmbH & Co KG in defence of Federal Court proceedings for breach of restraint of trade provisions contained in share sale agreement. Included successful application to cross-vest proceeding to the Federal Court due to Part IV claims raised by way of defence and counterclaim.Acted for National Australia Bank Limited and former receiver in their defence of a $36.6m damages claim allegedly resulting from the wrongful appointment of a receiver (Mizzi Pty Ltd & Anor v National Australia Bank Limited & Meredith [2009] VSC 369; [2010] VSCA 186).Acted for Permanent Trustee Co Ltd in a successful claim on a guarantee for payment of some $6m (Permanent Trustee Co Ltd v Gulf Import & Export Co & Anor [2008] VSC 162).Defended ANZ Banking Group Limited in Supreme Court proceedings issued by a former customer of Opes Prime Stockbroking Limited to recover losses following the company’s collapse. Included successful applications for security for costs and cross-vesting of proceeding to Federal Court (Solamind Pty Ltd v ANZ Banking Group Limited & Anor; 4 March 2009).Successfully defended The University of Melbourne (Faculty of Medicine, Dentistry and Health Sciences) in relation to misrepresentation claims by a former research scientist (Timar-Peregrin v University of Melbourne [2005] FMCA 806; [2007] FCA 742).
