About Gerald Richardson
As a management side labor and employment attorney, I help employers manage their relationships with their employees through the courtship, the marriage, and the divorce. In the courtship, I enable employers to recruit and to hire without liability for employment discrimination. During the marriage, I write employment agreements and employee handbooks that set the employer's expectations for its employees. I also advise employers regarding union avoidance, investigations of misconduct, discipline, and job performance improvement plans. At the divorce, I develop strategies to dismiss employees without liability for unfair labor practices, harassment, retaliation or wrongful termination. If disputes occur, I represent employers in litigation, arbitration, and mediation. I represent employers in federal and state courts nationwide in suits alleging employment discrimination, retaliation, wrongful discharge, breach of contract, violations of non-compete agreements, and employment-related torts. I have also defended employers before administrative agencies, such as the EEOC, NLRB, OSHA, and Department of Labor. In addition, I advise employers extensively regarding labor and employment law issues. Such advice has enabled employers to adopt cost-effective strategies to avoid (a) employee lawsuits, (b) enforcement actions by governmental agencies, and (c) discontent among employees that often prompts union organizing. As a speaker, I have addressed the Missouri Bar Association, the HRMA of Greater St. Louis, Mo. State Council of SHRM, Springfield Area Human Resources Association, the National Business Institute, Lorman Education, and both business and trade organizations regarding workplace topics.Employer's trusted advisor for union organizing, employee relations, overtime, FMLA, affirmative action and employee lawsuit prevention issues, employer's advocate in labor and employment litigation, arbitration, and mediation, and speaker on workplace topics. The Missouri Rules of Professional Conduct require the following disclosure in materials that describe a lawyer's services to the public: The choice of an attorney is an important one and should not be solely based on advertising.
Listed skills include Employment Law, Mediation, Arbitration, Litigation, and 20 others.
