Heather’s practice focuses on real estate, land use, and public and private financing in both Colorado and California. She represents public and private sector clients with small and large scale development projects, including infrastructure public-private partnerships, renewable energy projects in the United States and Canada, redevelopment projects, transit-oriented developments, airports, and residential, commercial, and mixed-use projects. Heather work on behalf of renewable energy clients includes representing developers on the acquisition of an early-stage projects, lenders in connection with loans for the acquisition or construction of renewable energy facilities, and investors financing their project portfolios, developing innovative royalty-generating service arrangements, or acquiring large, mature renewable energy projects. She also represents landowners and conservation organizations in complex conservation easement transactions throughout the mountain west; meeting the landowner’s goals for the current and future generations while also protecting tens of thousands of acres of land from development. Heather has a breadth of experience in commercial real estate transactions, understanding both the common issues involved in these transactions, such as title and survey matters, existing entitlements, and construction and financing obstacles and the more uncommon issues, such as Bureau of Land Management land exchanges, unique easement, license, and tenancy-in-common issues, and applicable tax credits and incentives. She has successfully protected agricultural lands, natural habitats, and open space with her representation of private landowners and conservation organizations, completing multi-year gift and bargain-sale conservation easements that required the coordination of numerous state and local government funders and foundations, negotiation of option agreements, subordination agreements, life estates, deeds, and tax credit applications.

Heather Haney was an associate in the Financial Transactions Practice Group in the firm’s San Francisco and Denver offices. Ms. Haney focused on the representation of financial institutions, other institutional lenders, and public and private borrowers in a broad range of secured and unsecured lending transactions. She also represented developers and other investors in early-stage power project development.Ms. Haney served as the firm’s Cleantech Program Manager (2011-2012), providing market analysis and strategic advice with respect to renewable energy, energy efficiency, smart grid, clean transportation, water, and energy storage. She managed daily operations of client-facing Cleantech work, set priorities and oversaw the execution of Morrison & Foerster's Cleantech strategy, provided support and guidance to the Cleantech Steering Committee, and represented the Cleantech Program with external constituency groups, including NGO's, governmental agencies, and associations.Ms. Haney previously served as Co-Chair on the Cleantech and Climate Change Committee at the ABA Section of Science & Technology. In this role, Ms. Haney worked to provide leadership on emerging issues at the intersection of law, science and technology.

Heather provided academic advising, skills training, and support for first year law students in Contracts, Torts, and Property. She created lesson plans and lead weekly tutorials reviewing the legal material while emphasizing transferable skills such as case briefing, rule analysis and synthesis, outlining, and exam-writing.
