Jim Horne has extensive federal and state trial and appellate experience involving a wide range of civil litigation matters throughout the Western United States. He has served as trial counsel in Product Liability claims involving various products, prescription medications, and medical devices including asbestos; urea-formaldehyde; Phentermine of the “Fen-Phen” diet drug combination; bone (pedicle) screws; the food supplements goldenseal and echinacea; football helmets; wall-mounted heaters; and other electrical equipment and appliances. He also has considerable experience with building and construction defect claims on behalf of contractors, building owners and occupants (condominiums, apartment buildings, hotels, parking and other facilities in the hospitality industry) as well as fire loss and property damage claims, including business interruption, loss of use, and loss of access claims.Mr. Horne was involved in the following representative appellate court cases:Braaten v. Buffalo Pumps, Inc., et al., 137 Wn. App. 32, 151 P.3d 1010 (2007); Port of Seattle v. Lexington Ins. Co., 111 Wn. App. 901, 48 P.3d 334 (2002); Broad v. Mannesmann Anlagenbau, 141 Wn.2d 670, 10 P.3d 371 (2000) (certified question from U.S. 9th Circuit Court of Appeals, 196 F.3d 1075 (9th Cir. 1999)); Kitsap County v. Allstate Ins. Co., 136 Wn.2d 567, 964 P.2d 1173 (1998); State of Washington v. Johnson, 104 Wn.2d 179, 703 P.2d 1052 (1985); Cultum v. Heritage House Realtors, 103 Wn.2d 623, 694 P.2d 630, 53 USLW 2387 (1985). He is the author of a chapter of the Washington State Bar Association’s Commercial Law Deskbook on "Federal and State RICO Acts, Civil and Criminal."
