Concentrating my practice in business litigation, I prosecute and defend lawsuits in the following areas: corporate, partnership, and shareholder rights disputes; mergers and acquisitions; ERISA and employment discrimination; federal and state securities regulation; unfair trade practices; tax controversies; and patent infringement claims.I try cases and argue appeals in federal and state courts, with extensive experience in the North Carolina Business Court. My representation includes litigating numerous class actions suits, from trials through appeals. Two of my cases have reached the U.S. Supreme Court. I represented Ford Motor Company in a decision establishing precedent for cutting off damages in employment discrimination suits. I also served as lead counsel in Hyatt v. Shalala, a case that spanned 20 years in the federal courts, resulting in new disability hearings for 150,000 North Carolinians. Outside my usual business litigation, I have also taken on federal and state constitutional issues, most recently in McCrory v. Berger, where I served as lead counsel in the North Carolina Supreme Court for three governors who successfully challenged the General Assembly for violating separation of powers under the North Carolina Constitution.In 1994, I was inducted as a Fellow in the American College of Trial Lawyers, and I was North Carolina chair for the American College in 2006-08. I also served as president of the North Carolina Bar Association in 2009-10.I am admitted to practice law in North Carolina.
