Mark is an attorney with Baird Holm LLP, representing management exclusively in the areas of employment law risk assessments, traditional labor relations, collective bargaining, human resource counseling and training, employment discrimination, wage and hour, wrongful discharge and interpreting the most complex employment legislation. Mark has over two decades of experience representing both public and private employers in collective bargaining, contract administration and enforcement, arbitration, defense of unfair labor practice charges, and organizing. Mark can draft or review all types of employment policies, substance abuse and drug testing procedures, executive contracts and non-compete agreements. Mark is frequently called upon to conduct or guide workplace investigations, including harassment investigations. To proactively prevent workplace challenges, Mark routinely counsels employers on the intricacies of complex legislation such as the Americans with Disabilities Act, the Family and Medical Leave Act, the Fair Labor Standards Act, and state and federal plant closing laws such as the Worker Adjustment and Retraining Act. To assist employers with their training needs, Mark has developed a nuts and bolts curriculum for front line managers and human resource professionals. Mark also has extensive experience advocating employer rights and defending alleged violations before the Wage and Hour and FMLA Divisions of the Department of Labor, the National Labor Relations Board, and state and federal EEO agencies.Mark received his law degree from West Virginia College of Law, where he was an editor and contributing author on the West Virginia Law Review. He is admitted to practice in Nebraska, Texas and West Virginia, as well as the U.S. District Court, District of Nebraska and Southern District of West Virginia; U.S. Court of Appeals, Fourth, Sixth and Eighth Circuits; and the U.S. Supreme Court.
