Some examples of my experience include:Litigated the largest ERISA class action which stemmed from a multi-billion dollar error in the plan’s calculation of participants’ opening balances when it converted from a traditional pension plan to a cash balance plan.Successfully litigated an employment/ERISA case involving novel issues of whether a release obtained from class members, purporting to release “all claims,” was valid. Successfully defended judgment on appeal and obtained rare reversal of low prejudgment interest award.Trial co-counsel in a shareholder action challenging an S-Corporation conversion that effectively squeezed out minority shareholders. The Delaware Chancery Court awarded $1.22 million to the plaintiffs as a result of the conflict of interest.Counsel in several actions challenging the constitutionally of the taking of property and discriminatory taxation schemes. On brief in appeal before U.S. Supreme Court case involving dormant commerce clause jurisprudence. Counsel in numerous successful corporate governance cases involving acquisitions, breach of fiduciary duties, and interlocking directorships. Counsel in securities fraud class action arising out of the defendants’ alleged failure to disclose material facts regarding financial improprieties at its Hong Kong subsidiary. $5,000,000.00 settlement.

Some of my work included:Counsel in multi-party patent infringement litigation over methods of extruding polymers to make resealable plastic bags. Issues involved validity of patent, comparison of processes, allegations of willfulness, contractual and common law indemnity, and market analysis for potential damages. Successfully resolved in settlement.Successfully resolved $600 million ERISA plaintiffs’ action against Arthur Andersen.Represented major utility in regulatory reconciliation proceedings and in responding to multiple criminal and civil investigations by federal, state and local authorities.

Litigation associate dealing with a variety of civil disputes. Highlights include litigating a multi-million website development dispute, defending a heavy equipment manufacturer in novel products liability action with potential liability reaching upwards of $1 billion, and anti-trust claims against tool manufacturer.
