I manage insurance claims in litigation by providing direction to outside counsel in the investigation, evaluation, and disposition of first and third-party residential insurance-based lawsuits. I also investigate and evaluate pre-litigation residential insurance disputes and subsequently engage in formal and informal conferences with insureds' counsel to obtain pre-suit resolutions to these claims.

Following the implementation of 542A of the Texas Insurance Code, I worked in concert with the Wellington claims litigation department to form a captive law firm (Poston Law Firm) within Wellington to handle the review and response to 542A notice letters on pre-litigation storm claims, as well as the early stages of litigated matters.

Engaged in defense of national insurance companies in first-party actions (including Hurricane Ike and Rio Grande Valley hailstorm litigation). Negotiated a favorable settlement for a client in a Tarrant County matter the day before trial. Drafted multiple summary judgment motions that resulted in the dismissal of numerous Hurricane Ike lawsuits filed against my client. Drafted numerous pre-trial briefs in a multi-million dollar insurance coverage matter that helped result in a take-nothing judgment in favor of our client.

(Civil Litigation, Insurance Defense, Personal Injury, Products Liability)Practice consisted of property damage and personal injury civil litigation at the state and federal levels. Obtained a dismissal with prejudice in federal court as to an individual’s premises liability lawsuit against a Czech Republic hotel. Drafted an appellate brief in a products liability matter that resulted in a favorable summary judgment ruling on behalf of our client being affirmed. Communicated directly with clients and opposing counsel, and remained intricately involved in multiple phases of litigation, including discovery, hearings, motion practice, and legal research.
