After a very successful career of medical device engineering and development spanning over 30 years, I made an exciting career change. I have spent the last 3 years doing patent prosecution work for a leading law firm as a registered patent agent. Under the direction of patent attorneys, I have personally drafted 35+ complete patent applications to be prosecuted in the US and foreign countries. I have also drafted 270+ Office Action responses (US and foreign). I additionally performed many other patent prosecution related tasks such as patentability assessments, appeal briefs, patent landscape analyses, examiner interviews, etc. In drafting patent applications, I have found my product development experience to be invaluable in drafting claims that protect product value, and in providing the right amount of detailed description. I also thrive on the challenge of defining the best response to overcome examiner rejections. It’s like solving a complex puzzle every day.From 2008 to 2015, having obtained my patent agent registration in 2008, I acted as in-house patent counsel for my company to maximize business valve through application of the patent system. During that time, I defined a business wide patent strategy and product specific patent strategies. I directed all patent procurement related activities ranging from drafting invention disclosure documentation to deciding what patents to file, and reviewing and approving all patent office submissions.Some of my more rewarding tasks were performing “freedom to operate” analyses in very crowded patent spaces, utilizing my technical expertise and patent knowledge in defining non-infringement strategies, and directing further product development work accordingly. In some cases, direct analysis of third-party patent prosecution histories proved valuable.One highlight of my in-house patent counsel role was directing the litigation activities regarding a patent infringement lawsuit (plaintiff). In this case, the asserted patents were thrown into reexamination which had to be overcome to move the suit forward which resulted in a sizable settlement.

As the VP of Technology, one of my roles was to define, establish, and manage an Intellectual Property program and then train executives, engineering, marketing, and sales personnel thereto. In this role, I reported directly to general outside or in-house counsel. My role in the IP program included many responsibilities as described below. • Define a company-wide patent strategy and product specific patent strategies.• Draft and manage all agreements including, non-disclosure agreements (one-way and two-way), third-party idea submission agreements, employee agreements, and the IP portions of contract and co-development agreements, etc. • Define and manage all confidential information and trade secrets.• Prevent contamination of innovative freedom by controlling all third-party confidential information.• Evaluate the patent value of all ideas in accordance with the patent strategies and make all patent filing decisions.• Draft invention disclosure documentation in preparation for patent application drafting.• Commission the drafting and filing of patent applications through outside patent counsel.• Review and approve all submissions to the patent office.• Perform “product clearance”/“Freedom to Operate” searches and assessments, document non-infringement arguments, and define product clearance pathways.• Manage the patent notification system.• Manage a patent budget including the payment of all maintenance fees.• Develop and analyze patent the portfolios/landscapes of competitors and monitor competitor patent prosecution histories.• One of my most rewarding experiences was managing a patent litigation suit where we sued a competitor for patent infringement.
