About Richard Irving

Your inventions need to be protected. I assist individual inventors, small companies and Fortune 500 companies in obtaining protection for their software-related inventions by creating exclusive legal rights.Computer-related inventions are sometimes difficult to protect. The U.S. Patent and Trademark Office will grant a patent only if your claimed invention is novel and non-obvious over previously existing technology. This is where I can assist you and your company. In order to effectively fight to obtain protection for your inventions, one needs to understand the particular technology of your invention or at least have a solid basis from which one can quickly learn and understand. I was a software engineer for a number of years before becoming a patent attorney. I designed and developed software applications in a number of technological areas and I have experience using a variety of programming languages. As a software engineer or a patent attorney I have worked with technologies such as data communications, voice communications, cellular telephone systems, navigation systems, parallel processing systems, computer security and real-time systems.I understand the language of software engineers and how to present software-related inventions to the Patent Office to obtain the protection you need. And, if some or all of your patent claims are rejected in an Office Action, I analyze the reasons for the rejection and develop arguments, as well as any amendments to the claims in order to prepare and file a Response to the Office Action. If requested, or if I believe it would be beneficial, I conduct an interview with the responsible Patent Examiner to better understand the Examiner’s reasons for rejecting any of the claims and to discuss my ideas for overcoming the rejection. My job is to ensure that your invention is fully protected from those who would use your hard work without paying or without your authorization.
