CURRENT DUTIES AND RESPONSIBILITIES: Assists the commander as the senior enlisted advisor of 400 active duty and Reserve Marines. Acts as principal enlisted assistant to the commander. Interprets, applies, and enforces an intricate field of Immigration and Nationality law. Adjudicates cases usually involving difficult, convoluted and/or sensitive situations: often these are discretionary, precedent setting, have high visibility; and/or are of great importance to the applicant and his/her family or descendants. Takes sworn testimonies and administers oaths, and by issuance of subpoenas, compels the attendance of witnesses and the production of documents. Performs legal and other research, analyses, and final adjudication of all types of applications and petitions for benefits such as adjustment of status to permanent resident, classification to apply for visas, waivers of inadmissibility and similar waivers, and cases involving issuance, cancellation and breach of bonds. Determines the scope of the required review and the hearing process, decides when a verbatim record is required, rules on objections, grants continuances, and receives evidence. Reviews and makes determinations on cases including but not limited to naturalization, citizenship at birth abroad, derivative citizenship, congressional grants of nationality, determination on citizenship, expatriation, and repatriation matters. Files and presents motions, legal briefs, and court orders in both federal and state courts in connection with a variety of naturalization functions, i.e., judicial oath ceremonies and denaturalization proceedings. Responsible for planning and conducting independent reviews concerning the eligibility and entitlement of persons seeking benefits, employment, and/or legal status under the Immigration and Nationality Act.
