Mr. Curtis focuses his practice in the area of employee benefit plans. Unique about Mr. Curtis is his vast experience both in advising benefit plans on important compliance issues and in representing them in a variety of litigation matters. He helps employee benefit plan trustees and administrators comply with important federal laws including ERISA, the Affordable Care Act, HIPAA, and COBRA. He assists plans with drafting legally compliant and enforceable plan documents, agreements, required participant notices, and other policies and procedures. He has assisted plans with IRS and Department of Labor audit defense, plan mergers, reviewing benefit claims, and negotiating and drafting contractual arrangements with professional service providers and other vendors. He has assisted plans’ with due diligence vetting of potential providers such as pharmacy benefit managers. His litigation experience includes defending plans in benefit disputes, pursuing plan participants who improperly received and retained benefits, and pursuing investment managers who engaged in prohibited transactions and breached their fiduciary duty. Mr. Curtis has extensive experience representing Taft-Hartley multiemployer plans in litigation matters to collect unpaid employee benefit contributions and withdrawal liability.
