I represent hospitals in individual and group appeals in administrative and federal court litigation, and also counsel them regarding payment and compliance. I also represent other clients in litigation contesting federal agency action. I have been recognized as a leading health lawyer, and speak frequently on issues of healthcare reimbursement litigation. Most notably, I litigated the seminal case challenging the CMS payment policy of including Part C Medicare Advantage days as Medicare Part A days in the Medicare DSH calculation after 2004, in which the D.C. Circuit vacated the agency’s 2004 rule on the issue (Allina Health Services v. Sebelius, 746 F.3d 1102 (D.C. Cir. 2014)). Thereafter, the agency continued to apply the same policy from the invalidated rule, so further litigation ensued. The D.C. Circuit issued a second decision in favor of the hospitals (Allina Health Services v. Price, 2017 WL 3137996 (D.C. Cir. July 25, 2017)), concluding that the agency was required under the Medicare Act to go through notice and comment rulemaking.
