Led by attorney Thomas Fafinski, MSP Law is a legal team within Virtus Law, PLLC focused on serving Managed Service Providers and the legal challenges that are unique to the MSP industry. Tom has served professional service organizations, primarily in the technology sector, in a general counsel capacity for nearly 30 years.
MSPs face many unique issues resulting from the remote management of their customers' IT infrastructure, especially due to the proactive nature of the services delivered, as well as the subscription model of receiving revenue. Further complications stem from the remote delivery of services via interstate wires, the transmission of sensitive, personally identifiable and confidential information from third parties, risk of loss due to inappropriate use of software by clients, copyright issues, and underestimated labor requirements associated with services. Added pressures exist due to national private equity group acquisitions in the space.
Tom has served as subject matter experts for national peer group organizations, has had many national speaking engagements relating to the issues described above, and has been a featured guest on several dedicated MSP podcasts and radio programs. The MSP Law team, comprised of lawyers licensed in multiple jurisdictions with varying legal specialties, has developed a national network of trusted local attorneys with whom they work to deliver legal and business consulting services.
Tom and his team function similarly to the general counsel model of a Fortune 500 in-house legal department, but for Managed Service Providers on an outsourced basis. While there are other law firms who provide MSP-focused counsel on technology issues, we are not aware of any other team that also specializes in providing general legal counsel to MSP companies. We offer subscription and flat fee billing arrangements, too—just like our MSP clients!
