Contracts Manager Seconded by Samsung C&TRiyadh, Saudi Arabia September 2013 – Oct. 2015Participated in the final stages of contract negotiation and close with Employer for this eight billion dollar Project. The Project is a major infrastructure project to be undertaken by a Joint Venture. Participated in the tender process through to closing of the main contract with Employer.Responsible with a team of subcontract Managers and Engineers for all subcontracting. Domestic and international purchases. Responsible to consider subcontract and Purchase Order deviations submitted by subcontractors and vendors.Responsible to manage change orders received from Employer. Responsible to document and prosecute claims with Employer, including delay claims. Responsible to document delays caused by Employer, and to analyze any concurrent delay asserted by Employer. Also responsible to draft responses to letters received from Employer, Subcontractors and Vendors and defend against claims from subcontractors. The focus during this time was to document all claims due to Employer and to position the Project for filing an Extension of Time claim, if necessary.Assisted Management and Construction Managers with matters of contract interpretation. In recognition of my accomplishments, the Project rewarded me with two promotions. Each promotion included increased responsibility.

Manage the prime EPC contract for construction of a 1.89 billion dollar construction of an alumina refinery in Ras Al Khair, Saudi Arabia. This prime contract was an Engineer, Procure and Construct (EPC) basis. Defend against delay claims from subcontractors. Draft and negotiate variations (“change orders”) with Employer. Draft final consolidated Extension of Time (“EOT”) claim for presentation to Owner. Preparation Document all claims against Owner including delays. Responsible to document all delays in support of EOT claim. Responsible to review or draft correspondence with Employer regarding EOT claim. The draft EOT claim was detailed, including our actual costs in many different categories. The EOT claim documented delays by Employer. The EOT claim also rebutted Employer’s claims of concurrent delay. As a result of the EOT claim I drafted, all issues regarding delay and extension of time were resolved on a basis very favorable to my client. Researched questions of contract formation under Saudi law (“Sharia”). As a result of my research it was shown that certain provisions of the EPC were inconsistent with Saudi law. As a further result, my client was released from compliance with these provisions. Releasing my client from these contractual provisions resulted in a significant cost savings to my client.Also responsible to defend against claims from subcontractors and vendors. Documented subcontractor delays to defend against subcontractor claims. Drafted or reviewed all correspondence with subcontractors and vendors. In recognition of my accomplishments, HDEC rewarded me with a promotion which included increased responsibility.
