Serving all fifty states with 35 office locations in addition to franchise data management service in more than 30 countries.• Design and maintain all client service agreements, channel partner and revenue sharing agreements, technology licenses, and Non-Disclosure Agreements.• Designated Privacy Officer responsible for oversight of all ongoing activities related to HIPAA, GINA, and HITECH as well as CCPA, GLB, GDPR. Document, implement, maintain, and enforce company-wide data privacy and security policy. Maintain all HIPAA Business Associate Agreements.• Generate marketing content and custom client communications.• Responsible for all benefits administration compliance relating to cafeteria premium conversion plans, health Flexible Spending Arrangements (FSAs), Health Savings Accounts (HSAs), Health Reimbursement Arrangements (HRAs), Dependent Care Assistance Programs (DCAPs) and transportation subsidy programs.• Oversee and ensure compliance to all matters relating to ERISA, the Affordable Care Act (ACA), the Internal Revenue Code, Medicare Secondary Payer rules, coordination of coverage issues as well as COBRA continuing coverage administration, federal and state employment laws, and federal labor laws, including the adoption and implementation of required legislative and regulatory changes. • Draft custom and model ERISA plan documents, Summary Plan Descriptions, Summary of Benefits and Coverage, Business Associate Agreements, as well as executive summaries and white papers relating to developing regulatory and legislative matters impacting employee benefits. • Provide training, guidance and technical support to staff performing Code Sections 125, 105(h), and 129 nondiscrimination testing, Form 5500 and DFVCP submissions, and ACA Sections 6055 and 6056 reporting.
